" Yo Le Pep.......Follow The Law on 13Th Month Fiasco!




The proposal for the 13 th Month Salary ( a Fiasco already) has been thrown out by the National Assembly in a very non shallot manner, like a dirty bag turning up for a wedding badly dressed.

Private Sector Ignored!

The draft bill was circulated to the private sector numerous times. But the Ministry of Employment did not register all the issues of concern. The Faure Administration insisted on presenting this Bill, hoping to make political gains on it, but that too back fired, as the more political experienced Wavel Ramkalawan and in house economist Ahmed Afif from LDS buried the Bill in its poor form, and hit a political jackpot at Le Peps expense, but due to their own fault......all the way.

Emergency Meeting To Drain Sinking Ship

Immediately, the next day, Minister of Finance Peter Larose, Minister Wallace Cosgrow was called to State House to meet the President, to brain storm the 13 th month salary to redraft a new Bill. It seems President Faure is defiant in the face of a big political defeat. But he cannot blame LDS, they played their cards very well. The blame rests with the Le Pep MNAs who are not up to speed to the level of politics in the National Assembly today, and of course, the Principal Secretary of Employment, Veronique Bresson who did NOT advance some key legal points we raised in Praslin when discussing this hair brain proposal, which will not only destroy the economy, but it violates the Seychelles Constitution above all, neither Le Pep or LDS took note of.
Missing from the meeting was the Attorney General, who can do some research to confirm that property rights, are not limited to land, but extend to possessions, assets.

Article 26 The Right To Property

Article 26 guarantees as a fundamental human right the Right To Property. The state may not interfere with the use and enjoyment of property, but for a compelling state interest. Le Pep, the money in the commercial bank accounts, of companies, you anticipate will pay for the 13 th month salary, is " Property", in the form of moveable, transferable, credit, bank notes belonging to the commercial entity a particular employee works for. This money, in the case of some companies will exceed SCR. 2 Million as pay out or more, above monthly salaries, is  a " Property" interest. You cannot give away, arbitrarily, capriously, what has not entered government coffers.  When you attempt to do this, you will be violating the rights of these companies, under the Seychelles Constitution, and so the rights of their shareholders.

What Allows A 13 th Month For Public Employees?

9,000 public employees benefit from Le Pep largess in government and they receive a "13 th Month Salary". How is that possible. Well, government raises revenue from taxes. From that, subject to legislative approval, it can do what it likes with that money. It can buy new cars for each new minister, while students risk their lives in old Tata buses and drunk drivers,, it can buy a plane, when a dingy would do, to get to an outer island, it can buy new furniture for State House, while desks in schools rot underneath the students. Basically, a government can do anything almost, with money it raises unless the legislature questions it, or the Public questions it. A government cannot do what it likes with money or " Property" belonging to another, which is being used and enjoyed by the other, as it chooses, within the law.

Article 27 Right To Equal Protection

Once again, Le Pep has great trouble swallowing the " Right To Equal Protection". Again, a little research into " Equal Protection Cases" will reveal clearly to the "Le Pep" that they CANNOT bring a BILL before the National Assembly that discriminates against ANY class of citizens, or entities of society, and overtly, openly, favor another class of citizens. In the case of the Employment Amendment Bill,et al, Le Pep literally attempts to steal monies of companies, force them to give it away to another class being workers. This CANNOT be done under the Seychelles Constitution. Again, it CANNOT be done.
The permission Le derogation under Article 27, is the amelioration of the condition of disadvantaged persons or groups [ Article 27 (2)]. Workers as a class cannot be considered to meet the bar of being a disadvantaged group in a socialist- communist state, historically. Perhaps, given our history, persons who were known members and supporters of the Democratic Party and later parts of SNP and LDS could be considered  a disadvantaged group, but not all workers across the board.

We Need Serious Bold Leadership 
The 13 th Month Salary Fiasco has been a political football at election time kicked on the pitch by SNP in the first round. In the second round, Le Pep got the ball, kicked it about, thinking it would guarantee it goals and goals. It has not, it never will. Nor will it ever give LDS any goals, save the embarrassment caused to Le Pep players mishandling it on the pitch. We need to deal with serious issues in our country. I appeal to President Faure and LDS Team, lets sideline this proposal. It is going no where, let the Nation focus on serious matters, and build a solid co habitation with the other by building yourself a reputation of seriousness, reasonableness, action.

Let's leave the judges out of this one.

No need for salary it is a denmotivator and encourage laziness.The actual BONUS system ,,,,,is fine and there is no need to make it an obligation.Why the bonus system practice by literally all businesses is better .....Firstly it is voluntary,...it is base on the financial and productivity health of a company ..that is more bonus when things go well and less or none when business is in a crisis just like the 2008 financial crisis whereby enterprise must do sacrifices to keep the business afloat and protect their workers from being sacked thus would have otherwise created more social and economic burden on state.

Now if Pl wants to give more to employees ....it can for instance ,,instead of government pocketing the CSR tax ..allow employers to use this tax as an increase employees benefit as part of the bonus their business are generously giving their employees annually .......
I think this is the only accepted solution for businesses already burden with a mutliples of taxes......

ionus match a performance-based culture..and is a shared reward(profit sharing bonus).It suggest a level of trust between employer and employees and enhance the view of a shared culture.Pl argued that "Already businesses are giving a annual bonus to their employees NEAr a 13th monthly salry"Right pl:::but the different from making an obligation and leaving it a vonluntary act is the former when things goes wrongs ...a forced bonus would help destroy ,bankrupt a company ,,,which the latter does not do.....for the altter is vonluntary and depend on the financial and productivity health of a company ...

I heard the fianancial minster talking about txing none Seychellois citizens .......it must be said that the latter under Michel were enjoying tax invasion,and all kinds of benefits ...it was time to make Eden Isalnd and others pay their dues.......The problem with it is that Pl said it will target "foreigners holding a Seychellois appsort" this is shit ,,,you either a Seychellois and enjoy the same laws or you a foreigner ...there is or should be no foregienrs with Seychellois passport ,,if they foreigners they are foreigenrs ,,you cannot have a foreigner with Seychellois and still called him or her a Seychellois .....
It seems to me that LAORSE is referring to those foreigners like the tons of tamil tigers who came as expats and Michel illegally handed them our passports ...well in this case ..all foreigners illegally holding a Seychellois passport should hand it over and be given a resident permit ......thereby abide by Seychelles rule of LAW ....
YOU A FOREIGN WITH PERMANENT RESIDENT PERMIT OR YOU A SEYCHELLÔIS ..THERE CAN BE NO CLASSIFICATION PL.....

foreigners WITH Seychellois passport AS larose CALLED THEM ..ARE IN FACT THOSE FOREIGNERS WHO mICHEL ILLEGALLY GIFTED OUR BIRTHRIGHTS TO(siva;jivay;ramaDoss,,ETC....NONE MARRIED TO SEYCHELLOIS RO HAVE RELALTIVE TIN SEYCHELLES ...IN OTHER WORDS ,,THEY DIDI NOT ABIDE BY RULE OF LAW ON THIS ISSUE)...THUS AN ILLEGAL .UNCONSTITUIONAL ACT PERPETUATED BY mICHEL ...THE SOLUTION IS TO REVOKE ALL THESE PASSPORTS AND REPLACE IT BY A permanent resident permit .........

The passports are an underlying fraud. So government can simply cancel the passports or not renew them, especially for those who have not spent 10 years in residency.
This issue has been raised by myself for years. Finally, government bends and listens.
I only wonder if it is not too late for the Faure Administration to address this issue. The Seychellois public is boiling over this.
We will see.

I heard Dr Larose saying a lots of things in regards to a multiples of new taxes for instance"increase tax at Airport on toursists ... A bad thing ......I would propose instead want that Dr Larose imposes a CARBON TAX on all vehicles -----instead of sucking toursists... seychelles is already an expensive destination...no need to suck toursists with an Airport tax.
Dr Larose said"That 13 th monthly salary would be a gesture by employers"well employers are ....already distributing a BONUS literally equate 13th monthly salary...no need to change the BONUS system in to an obligatory 13th monthly salary.

And additionally ,Note that all these five star hotels whcich have been illlegally authorized to built in National reserves ..are favored by the fact that in National like let say Ste Anne Island,,,No other hotels would be able to be built thus provide the existing hotel an advantage,,,for they benefit from the space ,island they built on.. --thus these hotels becuase they are built in NationalPark contribute a bit higher ---Ste Anne lodge ,Port launay with Guy Adam over seize five star hotels......

Ask Raffles why it built a hotel that looks like a battle ship?

I agree . This move is long over due. It will make all foreigners spect Seychellois, especially those South Africans on Eden island. Bunch of racists.
Now you will see the, running around trying to prove they are Seychellois to not pay taxes.

Well I think Mr Larose was listening to me when I mention about PROPERTY TAX is one way to pick up money from individual like foreign born who becoame Seychellois.Mr Gill responded like "it will kill small business" Well I didn't want to escalate with Christopher,He is what he is! Maybe he misunderstood the concept.To make it short I gave up! Today I am proud what I read from Monsieur Larose, a GREAT INTELLIGENT GUY from Glacis that use to ride a bicycle!
His father,known Per Larose is proud of you!

4:12 I am not sure what you are saying.
Property tax on foriegners I proposed to Danny Faure and Jean Paul Adam two years ago, and I have been writing about it for 10 years. As a consequence, I have been called to Eden Island a few times requesting that I stop writing about this subject. So your steam is mis placed.
The issue that is hurting small business, any business, is the 13 th month. Salary fiasco which amounts to stealing money from us like Rene stole land from Seychellois in post 1979 and he blamed it on Dr. Ferrari.
This issue is now placing great stress in our country and it is pissing off a lot of people, because government by Danny Faure because we know Danny Faure, we expect proposals to be serious and reasonable, not reactionary as Ramkalawan. Unfortunately, Danny Faure government has stolen Ramkalawan shoes and he is having trouble walking in it.
The better course of action is to get the country behind a serious defendable program.
Drop this 13 month salary fiasco, which Le Pep is forcing its MNAs to defend it, without any tools.
We need to empower our people in a serious manner, not turn them into thieves.
Rene and Farrari are retired. Do we learn from their mistakes or do we reinvent them?

Pl sazs in todays Nation ...we import 80 percent of food we consumed from abroad ..well pl it is a pl failure.
Take one outter island from glenny for chicken farming while collecting feather to fill pillow etc and bones for by products
/combine traditional farming with new tech namely HyDROPONIC
Organized the collection of bycatch on tuna seiners that is a boat equipped with refrigerators that goes around let say every 72 hours to collect the by catch //Possible pl may ask......_- _yes Norway has been doing for decades now.

Madagascar has small farmers producing rice then have difficulty to export or sell ////an Seychelles farmers organization could work in join venture or having share in these small rice farm /thus produce more rice for Seychellois //it is an import but because Seychellois has share or join venture//it is a win /win situation ...anyway we cannot produce rice in Seychelles...could also be other products
